My father had the same problem. On 30th he had his interview and the VO said he will get his passport back in 5 days. Well he did not get it back till yesterday. Today the status has changed on VFS website saying it has been sent by courier. Just wait a little bit longer and I am sure you will get it too. PRobably because of the holiday season they took more time than usual.

I don't think that with the EAD renewal receipt you can continue working. Right now, the EAD is valid for 1 year from the day the process and print your card and you cannot specify the employment dates(or they are ignored anyway). It works differently than an H-1B extension where you can specify the dates and even when they process you application say in April and you asked for it to start in march, the approval notice will have the starting period in March. For EAD, if they processed it in April, the starting date is in April.

Well How do you know that all the members who are registered with IV is aware of this Webfax? Did you guys notify them in anyway? Do you expect/mandate all the IV members should be checking the website/forums all the time? No Hard feeling.... Just my 2 cents

1) The immigration debate is really hot. Monday is when the action starts. its not something 2 years down the line. Hence, we hope that members keep on updating themselves by visiting the site regularly
2) We cannot send an email everytime we want to send a webfax because initially we were thinking of sending a new fax every 2 days last week. But on advise of QGA, we decided to send only one fax. If we had gone the route of sending a fax every 2 days, would it be appropriate to send an email every two days? We do not want to associate IV's newsletter with some junkmail that comes everyday!

Just got a word from our attorney that my case was approved on 09/08/2010. In my case USCIS did not update the website with the approved status! Not even a soft LUD.... I don't know their operating standard!
Thanks for many of you reading my post! So now you know even with out USCIS website update there is a chance that ones case would be approved.
Lesson learnt: Always check with attorney!
Now on to the final hurdle! I-485.

i had the same situation. your friend can apply for H1-B coz he is already counted. He'll loose whatever time that he is used on EAD and get the remaining time that is left on his 6 year period. If 6 years is already passed, he can still file for H1-B based on labor, 140 approval. In my case, my H1-B got denied coz of employer issues and i have an another H1-B with another company. Mean while i have filed AC21 with my new employer to be able to work..Hope this helps..
But will the remaining time not depend on H1 period left. Example, if first 3 years of H1 used followed by 1 year EAD use then one would still get additional 3 years for H1 without being counted against the cap. But you would still have to do consular notification instead of change of status as there is no status to change once you use EAD.

You can apply from your Wife's company for that You will be dependent and her's will be primary.
When submitting you need to enter Alien numbers obtained from the first filing.
The critical part of applying like this is both the I 485 receipts SHOULD get same A# associated.
Once one 485 is approved USCIS will cancel the other or you can write th service center where pending I 485 is to cancel with all related details.,
HAVING MORE OPTIONS IS ALWAYS BETTER!!

go through the AR 11 form online and after you complete the same you would see options to put in your receipt numbers , do the same for yourself and your secondary

It means a shit if a bill doesn't pass. As of right now, news reports have started suggesting that there may not be any immigration bill this year, which could imply - no immigration bill until 2009.

Take a look at this link. As per this, 2010 is the timeline promised by USCIS to clear all backlogs.

USCIS has been playing around with the definition of backlog... I believe the recent changes indicate that from now on only approvable cases will be considered a part of backlog. Meaning:
- if your PD is not current, or
- if your namecheck has started and is pending for <180 days
your case does not even count as a backlogged case... When they say they'll clear backlogs by 2010 what they mean is all approvable cases (PD current and Namecheck either clear or 180 days old) will be approved within the published timeframes (12-18 months for I-485).
For people stuck in retrogression such backlog reduction efforts have almost no meaning...

IMHO the proper response would have been that dude...this is technically illegal..and may cause problems...but personally i know a few people who've made through but YMMV.
It is not a misleading information..I told what happened to the people I know. Recently In march , mid march my friend filed H1 to h4 transfer and it got approved in 17 days. She did not work from October 2007 till date. She did not get any queries. There is one more case like this,. But hat person got her h1-h4 in one year with no queries, SOmetimes people do get queries, I do not know how they manage it.
So what is your advice to the OP. consult a lawyer. If she/he consult a lawyer, what will the lawyer say..Same thing, you are staying illegally here. Go back to India and apply fresh H4. Because I heard this from many lawyers. or they will simply file for H1 - H4 transfer.
Even then My advice is also consult a lawyer and let us know what did the lawyer say.Please update us. There are thousands of H1s who didnot get pay and converted to h4. Have all these people got queries are sent back to India. I dont think so. I am not saying staying without pay on H1 is not breaking law. it is breaking law. If all these payless H1 are breaking the law and USCIS finds them then thousands will be banned for 10 years from entering US rt. Can anybody tell me to how many people it happened till now?

I'll try that tactic on the others, see if it reduces them any more. Like I said, I've never really had to use Fireworks much before, so I've still got no idea of the best way to go about things, and all the little tricks you can do. :-\
