    lMy wife got RFE after this LUD, Mine and my kid's no change. Waiting for RFE details. I think since the processing time for Texas is Aug 2007 they are pre adjusting the apps, i guess.

    I too had SL on my 485 on 4/10/09 but none of my family members and nothing after that. Does this mean they have assigned my file to an IO?

    That is may not correct. Stuart Anderson was never a lobbist. But he did play a key role in AC21 law. Back then Stuart was Legislative Director for Sen. Abraham (R-MI). Stuart worked with key staffers across the aisle to recapture and pass other favorable provisions in AC21. In that sense, Stuart always had a front row seat to witness things unfold in front of him. This is what makes his book so unique.

    According to the website, Stuart is Adjunct Scholar at CATO institute and he is executive director of another policy institute called NFAP.

    Yes, I do get a separate approval notice every time.
    We did speak to our lawyer today and she thinks its not a big deal and its ok to travel. So we are thinking of going ahead with our plans!

    You should join your state chapter through the IV forums. State Chapter volunteers should plan to contact local politicians and meet them face to face. Nothing is more powerful than visiting face to face and impressing upon politicians how important this issue is.

    Looks like lot many ROW eb3 PD between AUG03-AUG04, 42% so far.
    Good news is not many ROW eb3 for AUG03. Date will going to move definately.



    I totally agree with you. I hope date will move fast now since there is not enough people in 2002-2003. I hope this will be same for India and china too. Let`s hope for the best.

    I would like to change my name from 'first middle last' to 'middle last' officially. I know that there is a lengthy process to do that on my passport. Is there any advice on how i can reflect that on my I-797? I currently hold a valid H1-B approval. The visa on my passport is for a previous H1 job that i've left now. I would like to change my name officially before making any more wrong stamps on my passport. Is this feasible? If so, can anyone throw some more lgiht on this?

    My employer says its the company's policy not to file for EAD or AP for all its employees. They are just filing the 485. I am sure that they(employer and lawyer) will not be giving me the 485 reciept too.

    What options do I have ?

    You can claim UI... I used the benefit earlier and the UI office was very helpful. It is insurance and a public burden. It would not be held against you in AOS adjustment. But again, I am not a lawyer so my opinion is strictly mine and should not be considered as legal opinion.....

    I have received an RFE on my I-485 application to provide a copy of birth certificate. However, I have submitted the birth certificate and affidavits from my parents when I filed for I-485.

    I am from India. Since the name is put after few months of birth, my name is not present in the birth certificate. I am not sure if the RFE is due to this. But all the (or most) people from India would be in the same zone, right (not having name in birth certificate) ?

    Is anyone in the same situation as me ? What kind of documents have you submitted for the birth certificate requirement ?

    We should not mention who we are speaking to in a public forum. This will trigger all kinds of opposition flooding to whomever you mention, which will work against us

    Join your state chapter, they will be able to help coordinate and get contacts and visits etc.


    I agree - It's not a good thing. Moreover, it might push the wrong buttons if person from one state sends letters/faxes to the congressman from other state. I would not be surprised if the congressman would not care since you are not from his district. You can also check if you can send the letters/faxes to your state senators...

    Hello NC-ians,

    I recently moved to NC, Used AP to for travel and the stamp in the I-94 says AP valid till May 2009, Have a approved I-797 H1 till 2011, also have EAD valid till 2010, what do they need to issue new license from outofstate person ?


    Please share your experience.

    Rally shoud emphasize that its not for increase in any H1B visa but to provide relief for people who are going through AOS to cut down the amount of time whole adjustment process takes.

    Depends on whether your I-140 is approved or still pending.

    Here what I think.

    Lets assume your I-140 is approved.

    Remember GC is based on future employment.

    Now if AILF wins lawsuite and USCIS accept your application you will get receipt date of July 2007. Your I-485 is not going to get processed in 6 months. It is surely not going to get adjudicated in 6 months. By Jan - Feb 2008 you will be able to invoke AC21 and change your intent and still be able to get your I-485 adjudicated. This all you can do working for a company other than the one who filed your I-140 / 485.

    Only risk here is that if USCIS processes your case in first 6 months and send you a RFE for a current Employment verification letter / paystubs. But again chances of this thing happening is rare and remote given the numbers of I-485 petitions they will receive in July 2007.

    my 2 cents.

    This is my personal opinion and Its always better to get an advise from a good immigration lawyer.
