Please don't travel till you get your 485 Receipts. Recently I read in one of IV forums that someone's application was rejected because he/she travelled while his/her application was in process. Talk to your attorney before doing it.

Rather than denying your application based on inadmissibility, we are holding adjudication in abeyance while the Department of Homeland Security considers additional exercises of the Secretary of Homeland Security?s discretionary exemption authority. Such an exercise of the exemption authority might allow us to approve your case."
My question is - I am married to a US Citizen, and have a child(yes I know I should have applied thru her- but did'nt) Can I apply for another GC thru wife.
Will my Work permit be renewed once it expires.

the question is about the type of visa needed to enter canada. I have pending I-485 in US but need visa to go to Canada. I have tourist visa for Canada but was wandering if I need to apply for a diferent visa to visit a client of my company for a few days. The reason of my visit is obviously not tourism...

I filed for 485 went to India came back to USA. I didn't have any 485 receipts with me.
Had no issues what so ever, in fact I was not asked anything about 485 application. After coming back went for finger printing , that means my application is still in process.
Important Note :- During this period I had valid H1b stamp on my passport.

I don't understand whats problem with fragomen - they will do everything in paper - never e-file a thing. I see lot of people e-filed their I-140 and already got notice date (second day of efile)!
Mine is in EB2 case and I had sent all documents (VOEs, Letters from HR of prev employers, W2 and usual) while labor was being filed itself.

The Department of State issued a letter to Section 245 Adjudications indicating that as of September 16, 2010, visas for FY2010 were no longer available for all family cases and for certain employment based cases (EB-2, EB-3, other workers, EB-4, and certain religious workers). FY2011 numbers will be available on October 1, 2010.

But both of my labor certifcates are from the same company. I read somewhere I-140 is for intending to employ me. How can they employ me in two categories one on EB3 and one on EB2.
Do you see any disadvantage if I file both from the same company.

Hi,
I came to the USA on F-1 student visa which is expired on 2005. Currently I have H1B status (I-797 form) (and NOT a stamped visa) and I-94 attached to the I-797 form.
My question is that. Can I visit Canada for less than 30 days and coming back without the need to get a visa (automatic visa re-validation) OR I have to get a visa?
I am worried because I never have a stamped H1B visa on my passoprt. Only H1B status + I94 which are not attached to the passoprt?
I need your help and how can I make sure as I do not want to lose my job.

I have a similar situation and I just asked these questions from my lawyer so I can answer somewhat. Either case, someone will correct me if I am wrong.
1.Can I add my spouse to my GC status when PD is not current?My spouse is on H1B visa.
Not until your PD is current or close to being current. Does she have an approved LC and I-1140, pending 485 (concurrent filing)? If she does u may have some advantages like cross-chargeability etc.
2.If I start using EAD, is it still possible to add spouse or I should maintain valid H1 status?
Doesnt matter as long as you maintain either H1-B or AOS(pending I-485)

What the denial notice says? Your options are to file a new H-1B ... in the meantime please appeal the case immediately as this will buy time.
Regarding other options, you can either re-enter US on B-1 or visit a consulate and get H-4 stamped.

Hi all,
This is for my friend who got his 3 year H1- B extension recently.
He planned to visit India for stamping and already booked the air ticket + consulate appointment.
But the Visa validity start date in his I-797A is incorrect. He joined this company only in 2006 but the start date shown in I-797A is sometime in 2001.
Though the END date is correct, Is it going to cause any problem in his Visa stamping?
He got only 2 weeks to fly and skeptical about the turnaround timeframe to file for correction.
His lawyer says it is a very minor problem and will not affect the visa stamping.
Please share any similar experiences / ideas.

IMO: 7th Year extn can be filed if PERM is pending for more than 365 days or if I-140 is approved.
You can also get 7th yr extension with approved labor. With approved I-140 you get 3 yrs of extension.

Assuming you qualify for a green card under EB-2, your new employer should do a PERM/ apply for an I-140 , and at that time seek the priority date of the already approved EB-3 I-140.
During all these process, make sure that you are on your H-1B.
